In consideration, the receipt and sufficiency of which is hereby acknowledged, for being allowed to participate in the CEMEX, Inc. (the “Company”) Earth Day 2021 Art Contest (the “Art Contest”), the undersigned hereby enters into this Art Contest Release (the “Release”).
The undersigned grant the Company permission to display the art submitted for the Art Contest (the “Art”), in any and all publications and grant the Company permission to photograph, film, or otherwise record the Art in connection with the Company’s Earth Day activities and to use the Art for any other lawful purpose. The undersigned waive and release any and all rights the minor and/or parent/guardian may have in the Art and any privacy and/or intellectual property or other interest in the Art and transfer all rights in the Art to the Company. The undersigned release, discharge, and hold harmless the Company from any liability by virtue of the use of the Art or images.
The undersigned understands that the Art will not be returned, and that the Art may be included in whole or in part or composite; distorted in character or form; included in conjunction with the minor’s name or reproductions thereof; included in color or otherwise. The undersigned agree to waive any right to inspect and/or approve the finished product that may be used or the use to which it may be applied. The undersigned give permission for these uses without the receipt of any financial consideration or compensation with regards to the reproduction of the Art. The undersigned release, discharge and agree to hold harmless the Company from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that might occur or be produced in the taking of said pictures, or in any processing tending towards the completion of the finished product. The undersigned further waive all claims and rights, monetary or otherwise, that might arise because of any additional or further use of the above described material at this or any other future time. The undersigned acknowledge that the Company shall retain sole right for designating the use of the Art.
We, the undersigned minor and parent/guardian certify that we have read, understand, abided and will continue to abide by all rules and regulation of the Art Contest. We further certify that the artwork is the minor’s original creation and is not a reproduction, in whole or in part, of another piece of art. The undersigned represent that they thoroughly understand that this is a complete and final release and indemnity agreement, that they are voluntarily entering into this Agreement, and that no representations, promises or statements made by any Company party, or any agent, attorney or other representative of any Company party has influenced the undersigned in causing them to sign this agreement
